When an aging parent can no longer make decisions and has no power of attorney, guardianship may be necessary. Here's how it works in Florida.
The process
Guardianship is a court process in which a judge appoints someone to make decisions for an incapacitated adult. It requires a capacity examination, a petition, and ongoing court oversight and reporting.
It's more involved and costly than a power of attorney — which is why setting up a POA early is so valuable.
Alternatives
Where possible, less-restrictive options (POA, health-care surrogate, representative payee) are preferred. An elder-law attorney can advise on the right path for your Tampa family.
